1. Agreement
These Terms of Service ("Terms") govern your use of the LobsterHost platform and services ("Services") operated by LobsterHost ("we," "us," "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Description of Services
LobsterHost provides a managed AI assistant platform. Each subscriber receives a dedicated AI assistant that can remember context, answer questions, assist with writing, research, planning, and other general productivity tasks.
3. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to agree to these Terms.
4. Account Registration
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
5. Payments and Billing
Paid subscriptions are billed in advance on a monthly basis. All payments are processed through Stripe. You authorize us to charge your payment method for recurring subscription fees until you cancel. Prices may change with 30 days' notice.
Free Trial: If offered, the free trial requires a valid payment method. You will be charged at the end of the trial period unless you cancel before it ends.
Refunds: Payments are non-refundable except where required by applicable law. You may cancel your subscription at any time, and cancellation takes effect at the end of the current billing period.
6. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law, regulation, or third-party rights
- Generate, store, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
- Generate content related to child sexual abuse material (CSAM)
- Develop weapons, plan violence, or facilitate terrorism
- Engage in fraud, impersonation, or deceptive practices
- Attempt to circumvent security measures or access other users' accounts or data
- Use the Services for spam, phishing, or unsolicited bulk communications
- Reverse engineer, decompile, or disassemble any part of the Services
- Resell, sublicense, or redistribute access to the Services without our written consent
- Use the Services in any manner that could damage, disable, overburden, or impair our infrastructure
We reserve the right to suspend or terminate your account for violations of these Terms, with or without notice.
7. AI-Generated Content Disclaimer
IMPORTANT: The AI assistant provided through LobsterHost generates responses using artificial intelligence. AI-generated content ("Output"):
- May not be accurate, complete, or reliable. You should not rely on Output as a sole source of truth or factual information.
- Is not professional advice. Output should not be considered or used as a substitute for medical, legal, financial, tax, therapeutic, or any other professional advice.
- May contain errors or biases. AI models are probabilistic and may produce incorrect, incomplete, or offensive content.
- Is your responsibility. You must evaluate Output for accuracy and appropriateness before relying on or sharing it.
We strongly encourage you to consult qualified professionals for important decisions regarding your health, finances, legal matters, or well-being.
8. Your Content
You retain ownership of all content you provide to the Services ("Input"). You are responsible for ensuring your Input does not violate any laws or third-party rights.
By using the Services, you grant us a limited license to process your Input solely to provide the Services to you. We do not use your personal content to train AI models or share it with other users.
9. Data and Privacy
Your use of the Services is also governed by our Privacy Policy. Each user's AI assistant runs on an isolated, dedicated server. Your data is not shared with other users.
10. Intellectual Property
The Services, including the LobsterHost website, branding, and software (excluding third-party components), are our property or the property of our licensors. You may not copy, modify, or distribute any part of the Services without our written permission.
11. Third-Party Services
The Services rely on third-party providers including, but not limited to, AI model providers, cloud infrastructure providers, and payment processors. We are not responsible for the availability, accuracy, or policies of third-party services.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LOBSTERHOST, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
14. Indemnification
You agree to indemnify, defend, and hold harmless LobsterHost and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your content or data provided through the Services.
15. Termination
You may cancel your subscription at any time. We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services ceases immediately. We may retain or delete your data in accordance with our Privacy Policy.
16. Dispute Resolution
Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Arbitration: Any dispute arising from these Terms or the Services shall be resolved through binding individual arbitration in accordance with the rules of JAMS. You waive any right to participate in a class action or class-wide arbitration. The arbitration shall take place in Los Angeles County, California.
Exceptions: Either party may seek injunctive relief in any court of competent jurisdiction. Claims under the small claims court threshold may be brought in small claims court.
17. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email or through the Services with at least 30 days' notice. Your continued use of the Services after the effective date of changes constitutes acceptance.
